Do Florida Businesses Need Security Cameras?
While Florida has no universal law requiring all businesses to install security cameras, certain industries are legally required to maintain video surveillance systems. Knowing the requirements for your business type can protect you legally and ensure compliance with Florida statutes.
Florida Businesses Required to Have Security Cameras
Bars and Nightclubs (Florida Statute 561.29)
Establishments holding alcoholic beverage licenses must maintain surveillance systems that cover entrances, exits, and the primary sales area. The Florida Division of Alcoholic Beverages and Tobacco (ABT) can require enhanced surveillance for venues with repeated violations. Cameras must retain footage for a minimum of 30 days.
Cannabis Dispensaries (Florida Statute 381.986)
Florida Medical Marijuana Treatment Centers (MMTCs) are required to maintain comprehensive video surveillance covering all areas where cannabis is grown, processed, stored, or sold. The state requires 24/7 recording, 90-day retention, and cameras capable of capturing facial detail. This is one of the strictest surveillance requirements in Florida.
Convenience Stores and Gas Stations
Under Florida's Convenience Business Security Act, convenience stores operating between 11pm and 5am must comply with security requirements that typically include a camera system covering the cash register area and parking lot. The Broward County ordinance adds specific requirements for stores in unincorporated areas.
Pawnshops (Florida Statute 538.09)
Florida pawnbrokers must maintain surveillance equipment capable of producing a clear image of any individual conducting a transaction. Footage must be kept for a minimum of 90 days.
Check Cashing and Payday Loan Businesses
Licensed money service businesses in Florida are encouraged (and in some municipalities required) to maintain video surveillance as part of their security plan submitted to the Florida Office of Financial Regulation.
General Commercial Camera Recommendations
Even when not legally required, commercial security cameras in Florida should:
- Cover all entry/exit points at minimum
- Have resolution sufficient to identify individuals (minimum 2MP)
- Store footage for at least 30 days (90 days for regulated industries)
- Include night vision or full-color low-light capability for outdoor cameras
- Be installed by a licensed alarm contractor in Florida (EF license)
ADA and Privacy Considerations
Florida law prohibits recording in areas where individuals have a reasonable expectation of privacy (restrooms, changing rooms). There is no requirement to post signs informing people they are being recorded in commercial establishments, but it is recommended practice.
